- Department of Intellectual Property (DIP)
The Department of Intellectual Property is the key institution engaged in the promotion of Intellectual Property (IP) and GIs in Thailand. Despite the responsibilities and commitments, it lacks competencies to guarantee internal controls, inspection and certification take place.
It has been established on 1992 and consisted of 200 governmental officials and 45 employees. The DIP has principal mission in connection with the promotion, development and protection of property rights. To this end, DIP has established mechanisms providing services aimed at protecting IPR and creating public confidence. The Department’s responsibility embraces the following: 1.protecting intellectual property rights under the law on geographical indications, patents, trademarks, copyrights, topographies of integrated circuits, trade secrets; 2. developing the protection of IPR and promoting the creation of new intellectual–property works 3. developing information technology systems in relation to intellectual property; 4. reforming and modernising laws related to IP; 5. building up mechanisms for protecting Thai IP both domestically and internationally and creating trade disciplines; 6. facilitating mediation and settlement of IP disputes.
Even if an Act on Protection of Geographical Indication has been issued by Thai Authorities [Act on Protection of Geographical Indication –B.E. 2546(2003)], equivalence to EC Reg. No. 510/2006 is not reached yet mainly because it lacks of any official control scheme and verification of compliance with specification (EC Reg. No. 510/2006 art. 10-11). Despite the responsibilities and commitment of DIP, competencies to guarantee Thai GIs protection in EU, must be supplied by European experts. Up to eight people will be invited to the project main events but a constant consultation with DIP is expected to take place during project implementation. Ensure that the main differences with EC Regulation are understood and that the case studies may serve as a guide and example to enforce the Thai national regulation on Official control and verification of compliance of specification, is a project expectation.
